Terms and Conditions
The performance of the contract is subject to the conditions below.
These cannot be varied in any way by the Client unless such conditions are agreed by the Photographer in writing.
In the following Terms and Conditions: "the Photographer(s)" shall mean Terri Pashley trading as Terri Pashley Photography or any photographer appointed by Terri Pashley Photography, "The Client(s)" shall be the couple whose names appear on the Booking Form.
Booking, Processing & Payment
a) A non-refundable £250 deposit (paid via bank transfer) along with a signed, completed booking form is required to secure the booking and this will ensure The Photographer does not take any further bookings for that date.
b) Any remaining balance is due 4 weeks before the date of the wedding.
c) No photographs will be taken on the day of the wedding until payment is received in full.
d) Where the wedding date is more than 12 months after the date of signing these Terms and Conditions, photographic services undertaken on the wedding date are supplied at the Photographer's prices as at the date of signing.
e) All reprint and album orders, if placed six months or more after the wedding date, are supplied at the Photographer's prices as at the time the Photographer receives such order.
f) Should the Client wish to cancel the booking, notice must be given at least 6 months before the wedding date. Cancellation within 6 months' notice will result in loss of deposit only. If less than 6 months' notice is given, the Client will be liable for 50% of the overall fee. (If less than 3 months' notice is given, the Client will be liable in full.)
g) If the date of the wedding is changed by the Client, the Photographer is under no obligation to be available to perform the contract on the new date. If the Photographer is unavailable on the new date, this will be deemed a cancellation by the Client and condition F applies. If the Photographer is available on the new date and is willing and able to perform the contract on this date, the deposit may then be transferred to the new date. Any new date will be booked at current pricing and the client will be liable for any increase.
h) Images will be supplied to the Client within 4 to 6 weeks after the wedding date
a) If The Photographer is unable to perform to the guidelines of this contract or cancels owing to any cause beyond their reasonable control, including but not limited to, total photographic equipment failure, sudden illness, injury, victim of crime, fire, explosion, storm, delayed flights, floods or other natural disaster or severely adverse weather conditions, The Photographer will contact other photographers of equal skill and professionalism. If Terri Pashley Photography is unable to provide another photographer that is agreeable to the Client, then all fees paid by the Client will be returned in full and Terri Pashley Photography shall have no further liability with respect to the agreement.
b) If The Photographer is unable to deliver the obligations in this contract for reasons outside the sole control of Terri Pashley, they will not be liable for costs in excess of the amount the Client has paid for photography. This limitation of liability will also apply in the event that digital images are lost through camera malfunction, damaged in processing, lost in the mail, or otherwise damaged or lost without fault of the photographers.
c) The digital files will only be kept 12 months from the wedding date. Should digital files be lost, damaged or destroyed after this period The Photographer will not hold any responsibility and no financial compensation will be given. Should digital files be lost, damaged or destroyed within 12 months of the wedding date, compensation will not exceed the total cost of the amount the Client has paid for photography.
d) Please note that any alterations made to the booking by the Client once details have been confirmed may only be made at the discretion of the Photographer and in some circumstances (such as the change of ceremony date for a wedding) the Photographer may be unable to accommodate these alterations due to a conflict of commitments. Under these circumstances the Photographer is not liable to compensate the Client in any way whatsoever.
a) Terri Pashley Photography may store your data on a private internal database. This data will not be made available to outside companies or individuals. Should you wish to have your data removed from the database, please advise in writing and retain your confirmation.
Food and Beverages
a) If photography package exceeds 5 hours of coverage, hot food and soft drinks must be provided for the Photographer(s), this will usually be served when the Client sits for their wedding breakfast.
a) Pre- wedding shoot must take part within 10 miles of Bromley unless agreed upfront with the Photographer
b) If Pre-wedding shoot exceeds this additional travel costs will occur
a) 40 miles of travel by road in the UK are included within all packages. Mileage exceeding this initial 40 miles will be subject to an additional charge of 30 pence per mile. Where Terri Pashley Photography incur additional costs other than stated in the contract agreement related to travel, including but not limited to fuel costs, flight costs and accommodation, this will be reimbursed by the Client prior to the wedding.
b) If the Photographer(s) mileage exceeds 100 miles, accommodation costs of up to £100 per night will be reimbursed by the Client.
c) International expenses must be paid within one month of booking.
d) Flights/Accommodation will be booked by the Photographer and paid by the Client. Flight costs will be determined at time of booking.
a) The copyright for all images produced remains the property of Terri Pashley Photography. The Client has permission to reproduce photographs and display them, including on social media sites, but not for publication in any other media without written consent from Terri Pashley Photography.
b) The Client is free to share, copy, distribute and transmit the images but at all times the Client must give credit to Terri Pashley Photography for the images used. The Client may not use the photographs for any commercial purposes without the express written permission of the Photographer.
c) Terri Pashley Photography reserves the right to use any image for promotional purposes, including but not limited to display, advertising, brochures, magazine articles, websites or other such promotional or portfolio material without payment or compensation to the client.
d) Permission to use the Photographs for purposes outside the terms of the licence will normally be granted upon payment of a further fee, which must be mutually agreed (and paid in full) before such further use. Unless otherwise agreed in writing, all further licences in respect of the Photographs will be subject to these terms and conditions.
Creative Licence & Coverage
a) Due to the weather and availability of subjects, photographing a specific moment cannot be guaranteed. Terri Pashley Photography is granted creative and artistic license to the photographs taken and their judgment on photographic style and number of images captured shall be deemed correct.
b) The Photographer shall use reasonable endeavours to photograph all individuals as requested by the Client at some point, but no responsibility will be taken by the Photographer on the occasion that someone is overlooked.
c) The Photographer will not be held responsible for any lack of coverage caused by the bride, groom or wedding party not being on time, or by the Church, Registry Office or other licensed place imposing any restrictions on the Photographer.
d) For a booking involving a church ceremony or at certain venues the Photographer(s) movements are sometimes restricted by the minister or official in charge. The area from which the Photographer is able to cover the ceremony may not be the Photographer's choice and the Photographer cannot accept responsibility for any obstructed view should this be the case. The use of artificial lighting may be restricted or prohibited. The photographing of parts or even all of the ceremony may be restricted or prohibited. The Photographer cannot be held responsible for any such restrictions in coverage. The Client is strongly advised to check with the appropriate authorities.
e) The Client takes responsibility for completing the schedule supplied by the Photographer prior to the wedding so that the Photographer is aware of key moments during the day. The Photographer shall not be liable for not photographing those moments that were not brought to their attention in such schedule.
f) The Client acknowledges that they are familiar with the Photographer(s) portfolio and is requesting services with knowledge of the Photographer(s) style, that the Photographer(s) work is constantly evolving and that in creating the photos the Photographer shall use their personal artistic judgment to create images consistent with their personal vision. Accordingly, the client acknowledges that the photographs shall not be subject to rejection on the basis of taste or aesthetic criteria.
g) The Client agrees that the Photographer shall be the exclusive stills photographer. The activity of another professional photographer or videographer or enthusiastic hobbyist can endanger the quality of the final product. Please notify us beforehand with contact details so that we can liaise with other parties and plan the photography accordingly.
